Ito po ay may kinalaman sa inyong liham kay Atty. Agripino G. Morga, Head Executive Assistant, Department of Interior and Local Government (DILG), na inindorso sa aming Kagawaran upang mabigyang katugunan ang inyong katanungan kung meron pang Court of Agrarian Relations sa inyong lugar diyan sa Gapan, Nueva Ecija. Ayon po sa inyo, kayo ay nagsampa ng kaso laban sa inyong mga kasama sa bukid (tenants) sa Brgy. Sta. Cruz, Gapan, Nueva Ecija, dahil sa hindi pagbayad ng buwis o renta; na tapos na ang 45 araw sa nasabing barangay tungkol sa kasong ito, kung kaya nais ninyong mailipat na ang usapin sa Court of Agrarian Relations; at, nais nyo ring malaman kung maaari kayong magfile ng complaint sa DARAB Cabanatuan City ukol dito.
Sa kasalukuyan ay wala na pong Court of Agrarian Relations. Nakasaad po sa seksiyon 50 ng Batas Republika Blg. 6657 ang ganito:
"SEKSIYON 56. Mga Kapangyarihang Quasi-Huridikal ng DAR. — Sa pamamagitan nito ang DAR ay pinagkakalooban ng pangunang kasaklawan upang malaman at pagpasiyahan ang mga bagay ukol sa repormang pansakahan at magkakaroon ng tanging orihinal na kasaklawan sa lahat ng bagay ukol sa pagpapatupad ng repormang pansakahan, maliban doon sa nasa tanging kapangyarihan ng Kagawaran ng Pagsasaka at Kagawaran ng Kapaligiran at Likas na Kayamanan.

Kaugnay po dito ay isinasaad sa letrang (a), (b) at (g) ng Section 1, Rule II ng Department of Agrarian Reform Adjudication Board (DARAB) Rules of Procedure ang mga sumusunod:
"Section 1. Primary and Exclusive Original and Appellate Jurisdiction. The Board shall have primary and exclusive jurisdiction, both original and appellate, to determine and adjudicate all agrarian disputes involving the implementation of the Comprehensive Agrarian Reform Program (CARP) under Republic Act No. 6657, Executive Order Nos. 228, 229, and 129-A, Republic Act No. 3844 as amended by Republic Act No. 6389, Presidential Decree No. 27 and other agrarian laws and their implementing rules and regulations. Specifically, such jurisdiction shall include but not limited to cases involving the following:
a) The rights and obligations of persons, whether natural or juridical, engaged in the management, cultivation and use of all agricultural lands covered by the CARP and other agrarian laws;
b) The valuation of land, and the preliminary determination and payment of just compensation, fixing and collection of lease rentals, disturbance compensation, amortization payments, and similar disputes concerning the functions of the Land Bank of the Philippines (LBP). (emphasis supplied)

g) Those cases previously falling under the original and exclusive jurisdiction of the defunct Court of Agrarian Relations under Section 12 of Presidential Decree No. 946, except sub-paragraph (Q) thereof and Presidential Decree No. 815. (emphasis supplied)
It is understood that the aforementioned cases, complaints or petitions were filed with the DARAB after August 29, 1987.

Sa mga nasabing probisyon ay maaaring idaing ang di pagbayad ng buwis o renta sa Provincial Agrarian Reform Adjudicator (PARAD) na may sakop sa usaping lupa.
