JOINT DAR-DENR-LRA NCIP MEMORANDUM CIRCULAR NO. 05-11

 

TO                :     To All Concerned Officials and Personnel of the Department of Agrarian Reform (DAR), Department of Environment and Natural Resources (DENR), Land
                            Registration Authority (LRA) and National Commission on Indigenous Peoples (NCIP)

SUBJECT    :     Extension of Time for the DAR-DENR-LRA-NCIP Task Force to Formulate the Joint Administrative Order on Addressing Conflicting Jurisdiction

 

     WHEREAS, the DAR-DENR-LRA-NCIP (DDLN) Joint Task Force convened on 25 January 2011 and met on several occasions to, among others, formulate the Joint Administrative Order addressing issues on conflicting jurisdiction within ninety (90) days therefrom, pursuant to Joint Memorandum Circular No. 1, Series of 2011;    HDTSIE

     WHEREAS, the DDLN Joint Task Force considered various case studies with actual conflicts of jurisdiction, and adopted the lessons learned in the drafting of the said Joint Administrative Order;

     WHEREAS, the draft Joint Administrative Order incorporated major agreements among and the consensus of the concerned agencies in resolving such conflicts in jurisdiction;

     WHEREAS, the ninety (90)-day deadline for formulating the said Joint Administrative Order has already lapsed;

   WHEREAS, the DDLN Joint Task Force extensively discussed the various case studies involving jurisdictional conflicts, and recommended measures to delineate the jurisdiction, responsibilities, and scope of work pursuant to each agency's mandate;    TESDcA

    WHEREAS, the DDNL Joint Task Force's initial draft of the Joint Administrative Order requires further study, revision, or refinement, as well as a thorough evaluation by all concerned agencies, so that a comprehensive policy issuance on the rules and regulations, procedures, and systems on how to address conflicts of jurisdiction can finally be formulated; and

    WHEREAS, the DDNL Joint Task Force Technical Working Group (TWG) has requested for a sixty (60)-day extension period within which to finalize the said Joint Administrative Order.

    NOW, THEREFORE, Be It Resolved, that an extension period of sixty (60) days from April 14, 2011, or up to June 13, 2011, be granted for the DDNL Joint Task Force to submit the proposed Joint Administrative Order to the heads of the four (4) agencies concerned.
