REPUBLIC ACT NO. 460

 

AN ACT REGULATING THE OPERATION OF SAWMILLS, REQUIRING OPERATORS OF SAWMILLS TO OBTAIN FROM THE DIRECTOR OF FORESTRY PERMITS FOR THE OPERATION OF SUCH SAWMILLS, AND PROVIDING PENALTIES FOR THE VIOLATIONS THEREOF

 

SECTION 1.  No person, association or corporation shall operate a sawmill without first securing a permit from the Director of Forestry. Said permit shall be issued under such terms and conditions as may be prescribed by the said Director with the approval of the Secretary of Agriculture and Natural Resources: Provided, That the Director of Forestry shall not issue such permit to any person, association or corporation which is not a holder of a timber license, unless said Director is satisfied as to the source of adequate supply of timber for the sawmill of such person, association, or corporation.

SECTION 2.  Every applicant for a permit to operate a sawmill shall file with the Director of Forestry a statement showing: (1) the name, citizenship, and residence of the owner or operator of the sawmill, or the name of the association or corporation, in case the applicant is an association or corporation; (2) the description of the equipment used in the establishment; (3) the cost or value of such equipment; and (4) the location of the sawmill.

SECTION 3.  Each sawmill operating in accordance with the provisions of this Act shall have displayed on its premises in a prominent place exposed to public view the permit issued under this Act.

SECTION 4.  With the approval of the Secretary of Agriculture and Natural Resources, the Director of Forestry shall issue such rules and regulations as may be necessary to carry out the provisions of this Act, including regulations prescribing the annual fees for the permits to be granted thereunder, which shall be graduated on the basis of the output of the sawmills and which shall in no case exceed one thousand pesos for any permit.

SECTION 5.  Any person, association or corporation, which shall operate a sawmill without the prescribed permit or which fails to display on its premises such permit or which shall violate any of the provisions of this Act and the rules and regulations issued thereunder, shall be punished by a fine of not less than one thousand and not more than ten thousand pesos.

SECTION 6.  This Act shall take effect upon its approval.
