MINISTRY MEMORANDUM CIRCULAR NO. 27-78

SUBJECT    :     Authorizing MAR District Officers to determine and fix the provisional
                              rental over all tenanted agricultural lands

            Pursuant to Section 12 (a) of Presidential Decree No. 946, the Ministry of Agrarian Reform is authorized to determine and fix provisional rentals by this Ministry is required before any case involving the determination of rentals shall be taken cognizance by the Courts of Agrarian Relations. Excepted are those cases brought directly by the tenant-farmer before the Courts of Agrarian Relations.   ICAcHE

            For the purpose of expediting the resolution of any petition for fixing of provisional rental, all MAR District Officers are hereby authorized and empowered to determine and fix the provisional rental in all tenanted agricultural lands in the name and on behalf of the Minister of Agrarian Reform.

            In the discharge of this function, District Officers are enjoined to observe and be guided by the provisions of Section 34 of R.A. No. 3844, as amended.

            Should any of the parties disagree with the provisional rental as determined by the District Officer, he may take the matter to the Court of Agrarian Relations for final determination.   acIHDA

            A copy of all resolutions fixing the provisional rental should be furnished the Minister and the Regional Directors for their information.

            All orders, circulars, memoranda and rules and regulations or portions thereof inconsistent herewith are hereby revoked, cancelled or modified as the case maybe.

            This Memorandum Circular is effective today, November 21, 1978, and shall continue in force and effect until revoked.

            Please be guided accordingly.
