MINISTRY MEMORANDUM CIRCULAR NO. 17-81

 

SUBJECT    :     Guidelines Governing Voluntary Offer Of Sale Of Tenanted Agricultural
                           Lands Devoted To Crops Other Than Rice And Corn

 

            The following guidelines are hereby promulgated to govern voluntary offers of sale of tenanted agricultural lands devoted to crops other than rice and corn:   DAHaTc

 

1.         The landowner and the tenant and/or lessee can enter into mutual agreement under reasonable terms and conditions for the sale of such lands to the said tenant.

 

2.         If the tenant and/or lessee cannot finance such purchase, he may apply to the Land Bank and/or other banking institutions through the Ministry of Agrarian Reform which, after determining the suitability of the land for purchase, shall, recommend the acquisition of the said landholding to the Land Bank of the Philippines pursuant to Sections 51 and 74 of R.A. 3844 as amended and/or other banking institutions whether government or private. pursuant to Presidential Decree. No. 717 dated May 29, 1975 and Central Bank Circular No. 473 issued pursuant to Monetary Board, Resolution No. 1286 dated June 27, 1975.

 

3.         In the preliminary processing of application for voluntary purchase and sale, the following documents should be submitted to the MAR Team Office where the property is located:

a)         A written voluntary offer or notice of sale to the tenant;

b)         Acceptance of such offer in writing by the tenants and a written application filed with the MAR for financing of the same by the Land Bank or other banking institutions;

c)         If land is titled, xerox copy of the Title/s duly certified by the Register of Deeds as the exact copy/ies of the Title/s on file;

d)         If land is untitled, Tax Declaration covering the property as appearing in the Approved Survey Plan filed pursuant to P.D. No. 76 showing the Lot Number and correct area of property, duly certified by the Provincial Assessor concerned;

e)         Sketch plan of the landholding showing the extent of the occupancy by the tenant/s to be prepared by the MAR Team Office, certified by the Team Leader.

4.         Upon completion of the preliminary processing of the application, the Team Leader shall forward the documents together with his recommendation to the MAR District Office which shall in turn indorse the same to the MAR Regional Director for recommendation to the banking institution concerned.   TAIaHE


5.         In case no favorable action can be secured from the local banking institutions, the MAR Regional Director shall forward the application together with pertinent documents to the MAR Central Office (Attn: BLADD) which shall study the feasibility of recommending the financing of the acquisition to the Land Bank of the Philippines or other banking institution.
