DAR MEMORANDUM CIRCULAR NO. 24-96

 

TO                :     All DAR Regional Directors, Provincial

                           Agrarian Reform Officers and All
                           Concerned Employees of the DAR

SUBJECT    :     Amendment to Memorandum Circular
                           No. 14, Series of 1994 Entitled "Additional
                           Measures to be Observed in the Preparation
                           of Collective Certificates of Land
                           Ownership Awards (Collective CLOAS)
                           Described in DAR Administrative Order
                           No. 3, Series of 1993"

 

In order to insure the integrity of collective Certificates of Land Ownership Award (CLOAs) issued to the Agrarian Reform Beneficiaries (ARBs) of the Comprehensive Agrarian Reform Program (CARP) and the legitimacy of the ARBs whose names are annotated at the back of the collective CLOAs, the following guidelines are hereby prescribed for the guidance of all concerned.   ACTIcS

Section A of Memorandum Circular No. 14, Series of 1994 is hereby amended to read as follows:

1.         Prior to the generation of a collective CLOA, the MARO's certified list of ARB applicants (Annex "A") duly sworn to before a notary public, shall be posted at the barangay hall, municipal hall and other conspicuous places where the property is located for a period of seven (7) working days. Said posting shall be certified by the MARO, the BARC chairman and the barangay captain after the lapse of the prescribed posting period (Annex "B").

            In case of protest, the petition shall be filed with the PARO who shall resolve the case within five (5) working days from receipt of the petition. Appeals may be filed with the Regional Director who shall resolve the protest within five (5) working days, otherwise, the list becomes final.

            All pages of the CLOA, i.e., those containing the names of the ARBs shall be initialed (countersigned) by the PARO and the RD.

2.         All names of the ARBs, after the lead name, which appear on the face of the Certificate of Title, shall be typewritten on the succeeding pages of the title, with each name numbered consecutively, from "1" onwards, alphabetically arranged and reflecting the complete names (Given, Middle and Surnames) of FBs.

3.         After the last typewritten ARB's name, and immediately below the line, the words "NOTHING FOLLOWS" shall be typed.   HCIaDT

This Circular takes effect immediately.
