We are furnishing you herewith, for your information and guidance, copies of LRC Circular No. 328 dated June 8, 1978 regarding the amendment of the procedure for the registration of Deed of Assignment covering landholdings affected by Presidential Decree No. 27. TO : All Registers of Deeds and Branch Deputy Registers of Deeds
SUBJECT : Amendment of the procedure for the registration of the Deed of Assignment
In order to facilitate payment of compensation to landowners who have been affected by Presidential Decree No. 27, the guidelines indicated below shall be followed: acSECT
1. The Department of Agrarian Reform automated system produces a "Masterlist of Parcels Per Title" for each titled property that is being processed for payment of compensation. The list indicates all lands that have been affected within a specified area and provides data on the tenant's name, certificate of land transfer number and other relevant information. The Masterlist shall be kept as a permanent record in the Registry of Deeds to support any action taken involving the Certificates of Land Transfer listed therein. The Department of Agrarian Reform will issue a duplicate copy of the Masterlist to the Land Registration Commission which shall transmit the same to the Register of Deeds concerned. The Land Bank of the Philippines or the Department of Agrarian Reform may issue a certified copy of the Masterlist to the landowner who has a claim for compensation pending in said bank.
2. Whenever a Register of Deeds is requested to register a Deed of Assignment executed by a landowner in favor of the Land Bank of the Philippines, he shall utilize the Masterlist as a land transaction register which in effect will authorize him to annotate the Deed of Assignment on the Torrens Certificate of Title covering the property, if it is titled, indicating thereon the date and page number of the Masterlist on which the Certificate of Land Transfer for untitled property using the Masterlist of Parcels Per Title as a basis and shall enter a memorandum of said Deed of Assignment in said record book indicating therein the date and page number of the Masterlist. The Register of Deeds shall sign or initial each page of the Masterlist to indicate that action has been taken affecting the same.
3. The Deed of Assignment executed by the landowner in favor of the Land Bank of the Philippines shall be registered even without the owner's duplicate of the Torrens Certificate of Title and the owner's copy of the Certificate of Land Transfer and the copy transmitted by the Land Registration Commission to the Register of Deeds concerned.
4. In the event that a new transfer certificate of title is requested to be issued in favor of the Land Bank of the Philippines, the owner's duplicate copy of the affected Torrens Title shall be surrendered and all other registration requirements shall be complied with.
This amends LRC Circular No. 328 dated April 4, 1978.
