LRC CIRCULAR NO. 14-A

TO                :     All Registers of Deeds and Branch Registers of Deeds

      This Ministry has been receiving complaints from various registrants regarding hardships encountered by them in some Registries of Deeds as a result of the implementation of this Ministry's Circular No. 14 dated March 15, 1979 requiring the submission by every registrant of a deed of sale, mortgage, etc. involving private agricultural lands, of a certification from the Ministry of Agrarian Reform (MAR) that the land subject of the transaction is not covered by Operation Land Transfer pursuant to P.D. No. 27. It appears that some Registers of Deeds have been requiring registrants to secure the MAR certification even in cases of transactions involving residential, commercial, or industrial lands.   aCIHcD

      For the convenience of registrants and to avoid unnecessary delays in the registration of documents involving lands other than private agricultural lands, you are hereby directed to refrain from imposing the requirements under Circular No. 13, dated April 2, 1975 and No. 14, dated March 15, 1979 (referring respectively, to the affidavit of non-tenancy and the MAR certification) upon registrants where the lands involved are obviously residential, commercial or industrial lands, as the case may be, as shown by the corresponding tax declarations.   DSETcC
