SUBJECT    :      Clarification on Cut-Off Date of Lease Rental Payment of OLT Beneficiaries Pursuant to MAR Memo Circular No. 6 Series of 1978.

In response to the queries made by farmers pertinent to Memorandum Circular No. 6, Series of 1978, this Ministry holds that for purposes of determining the cut-off period for lease rental payments by OLT beneficiaries, the date the Minister or his duly authorized representatives has finally approved the average gross production data established by the BCLP, or upon signing of the LTPA by the landowner and his tenant-beneficiaries shall be the reckoning date and if such date falls during the month the crop is to be harvested, the cut-off period shall take effect immediately after the harvest. Any subsequent protest or request for reconsideration of the approved or agreed average gross production data shall not be a ground for the suspension of the cut-off period. This means that the landowner concerned can no longer demand payment of lease rentals from farmer-beneficiaries who are to pay the Land Bank of the Philippines their corresponding lease rentals/amortizations pursuant to the Memorandum Circular aforecited.   CDHAcI
