JOINT DAR-LBP MEMORANDUM CIRCULAR NO. 04-01

SUBJECT : Guidelines In The Processing And Payment Of Idle Lands With Slopes Of
Below Eighteen Percent (18%)
I. PREFATORY STATEMENT
Under the Comprehensive Agrarian Reform Program (CARP), all lands with eighteen percent (18%) slope and above, except those already developed, shall be exempt from the coverage of CARP. However, there are lands with slopes of below 18% which are found to be undeveloped/idle and with no history of production at the time of field investigation, hence, suitability to agriculture could not be established.
In order to facilitate the distribution of idle lands described above, the following guidelines are issued.
II. COVERAGE
These guidelines shall cover all land transfer claims involving undeveloped/idle lands with slopes of below 18%, with no history of production, and whose valuations are in process and/or not yet covered by Memorandum of Valuation (MOV) as of the date of effectivity of this Joint Memorandum Circular (JMC).
III. PROCESSING AND PAYMENT PROCEDURES
In addition to the usual pre-processing requirements, the following documents shall be included in the Landowner's (LOs) Claim Folder:
a. Certification from Department of Agriculture (DA) that the undeveloped/idle portion (with slope of below 18%) is suitable to agriculture, citing among others, the crop/s that could be economically grown in that particular type of land; and
b. Certification from the Municipal Agrarian Reform Officer (MARO) that there are willing takers of the undeveloped/idle portion of the property (see Annex A). TDSICH
In the absence of the DA's and the MARO's Certifications, the subject idle land portion shall be segregated and excluded from CARP coverage.
IV. REPEALING CLAUSE
All orders, circulars, rules and regulations inconsistent herewith are hereby revoked, amended, or modified as the case may be.
V. EFFECTIVITY
This JMC shall take effect ten (10) days after its publication in two (2) national newspapers of general circulation, pursuant to Section 49 of Republic Act No. 6657.
