CSC MEMORANDUM CIRCULAR NO. 21-10
TO : All Heads of Constitutional Bodies; Departments, Bureaus, Offices and Agencies of the National Government; Local Government Units; State Colleges and Universities; and Government Owned or Controlled Corporations with Original Charters
SUBJECT : Entitlement of Compulsory Retirees to Salary Increases for Services Rendered During the Period of Extension
Pursuant to CSC Resolution No. 10-00020 dated August 16, 2010, the Commission has resolved the following:
1. To allow the entitlement of compulsory retirees to salary increases only for services rendered during the period of extension;
2. Any previous issuances of the Commission that are in conflict with the afore-mentioned Resolution are deemed modified, revised or repealed accordingly; and
3. The afore-cited Resolution shall be prospective in application.
This Memorandum Circular shall take effect fifteen (15) days after the publication of CSC Resolution No. 10-00020 dated August 16, 2010 in a newspaper of general circulation. caIE

ENTITLEMENT OF COMPULSORY RETIREES TO SALARY INCREASES FOR SERVICES RENDERED DURING THE PERIOD OF EXTENSION
WHEREAS, Section 12 (14), Chapter 3, Title I, Subtitle (A), Book V of E.O. No. 292 provides that the Commission shall have the power to act on all appointments and other personnel matters in the Civil Service including extension of service beyond retirement age;
WHEREAS, Section 12 (2), Chapter 3, Title I, Subtitle (A), Book V of the Administrative Code of 1987 (Executive Order No. 292) empowers the Civil Service Commission or the Commission to prescribe, amend and enforce rules and regulations to effectively carry out its mandate;
WHEREAS, Section 12, Rule XIII of the Revised Omnibus Rules on Appointments and Other Personnel Actions (as amended by CSC MC No. 27, series of 2001 dated October 8, 2001) states, among others, that the Commission may allow the extension of service of a person who has reached the compulsory retirement age of 65 years, for a period of six (6) months only unless otherwise provided, and that such extension may be for a maximum period of one (1) year for one who will complete the fifteen (15) years of service required under the GSIS Law.
WHEREAS, Section 5.8 of National Budget Circular No. 521 dated July 1, 2009 (Implementation of the First Tranche Monthly Salary Schedule of Civilian Personnel and Base Pay Schedule of Military and Uniformed Personnel in the National Government, as well as the Modified Position Classification System) states that compulsory retirees whose services have been extended beyond June 30, 2009 shall likewise be entitled to salary increases effective July 1, 2009. WHEREFORE, in view of the foregoing, the Commission hereby RESOLVES as it hereby RESOLVED to allow the entitlement of compulsory retirees to salary increases only for services rendered during the period of extension.
Any previous issuances of the Commission that are in conflict with this Resolution are deemed modified, revised or repealed accordingly.
This Resolution shall be prospective in application and shall take effect within fifteen (15) days after its publication in a newspaper of general circulation.
